The recent judicial developments in the Salus Pharmaceuticals matter have brought renewed attention to the importance of clarity and coordination in pharmaceutical regulation.

The Himachal Pradesh High Court, Shimla, in its judgment dated 7 May 2026, examined issues relating to regulatory jurisdiction under the Drugs and Cosmetics Act, 1940, and quashed the proceedings in the matter.

The matter subsequently came before the Hon’ble Supreme Court of India, which on 15 September 2026 dismissed the Union of India’s SLP, leaving the High Court’s judgment undisturbed in the particular case.

For the pharmaceutical industry, the development is an opportunity to further strengthen clarity, coordination and consistency in regulatory processes.

The industry greatly values the important role of CDSCO and State Drug Regulatory Authorities in ensuring the quality, safety and efficacy of medicines. Constructive coordination between Central and State authorities, along with continued engagement with industry, can further support an efficient and predictable regulatory environment.

For Himachal Pradesh, home to one of India’s important pharmaceutical manufacturing hubs, such clarity can contribute positively to compliance, ease of operations and continued investment in the sector.
